This website is operated by Damda. Throughout the site, the terms “we,” “us,” and “our” refer to Damda. By visiting our site or purchasing from us, you agree to these Terms of Service and to the policies linked on our site, including our Refund Policy, Shipping Policy, and Privacy Policy.

Online store terms

You may use our store only for lawful purposes. You may not use our products or website in a way that violates applicable law, infringes another person’s rights, introduces malicious code, or interferes with the security or operation of the service.

Personalized artwork and customer photos

House portraits are our specialty. We also create watercolors from photos of people, families, pets, and meaningful places. Products include canvas prints, AirFrame prints, pillows, mugs, and kitchen hand towels. You confirm that you own or have permission to use the photos you submit. You grant Damda limited permission to process your photos with our AI and production service providers as needed to create previews, print your selected product, provide customer service, and fulfill your order. We will not use your photos for advertising without separate permission.

AI-generated watercolor artwork is an artistic interpretation. Review the result and any personalized text before selecting it and ordering. Up to five previews per session are available, including regenerated versions. Color, detail, cropping, placement, and scale can differ between the photo, screen preview, and finished product. There is no separate emailed proof or included manual revision.

Orders, prices, and payment

All prices are shown in U.S. dollars unless otherwise stated. We may correct pricing, description, or availability errors and may decline or cancel an order when necessary. If we cancel an order after payment, we will refund the amount charged. Payment must be successfully authorized before an order is accepted.

Cancellations and returns

You may cancel for a full refund before production begins. Production may begin after checkout. Please contact us promptly for cancellation or change requests. After production begins, change-of-mind cancellations are not available. Remedies for damage, defects, and incorrect items are described in our Refund Policy.

Production and shipping

We currently accept and ship orders only within the United States. Production and delivery estimates are not guarantees and may be affected by carrier delays, address issues, weather, holidays, or other events outside our reasonable control. Product information

We make reasonable efforts to display product images, colors, sizes, and descriptions accurately. Screen settings and the AI-generated artwork and the printing process may cause reasonable variation. Measurements are approximate.

Intellectual property

The Damda name, logo, website design, copy, graphics, and original content are owned by or licensed to Damda and may not be copied, reproduced, sold, or exploited without written permission, except for personal use of a product you purchased.

Third-party services and links

Our store may rely on third-party services, including Shopify, payment providers, production partners, shipping carriers, and optional links to third-party websites. Their services may be subject to separate terms and privacy practices. We are not responsible for third-party websites or services outside our control.

Disclaimer and limitation of liability

To the fullest extent permitted by law, the website and services are provided on an “as available” basis. We do not guarantee uninterrupted or error-free access. Damda will not be liable for indirect, incidental, special, or consequential losses arising from use of the site or products where such exclusions are permitted by law. Nothing in these Terms limits rights that cannot legally be limited.

You agree to be responsible for claims arising from your unlawful use of the site, your violation of these Terms, or your submission of content that infringes another person’s rights.
